Policy Overview This policy outlines the professional standards expected from all drivers operating vehicles on behalf of the company. It is designed to promote safety, compliance, and professionalism in line with current legislation and industry best practice.

Daily Walkaround Checks
All drivers must conduct a thorough daily walkaround check of their vehicle before commencing duty. This includes inspecting tyres, lights, mirrors, fluid levels, and any visible defects. A checklist must be completed and retained as evidence.
Legal Insight:
Under the Road Vehicles (Construction and Use) Regulations 1986, it is a legal requirement to ensure a vehicle is roadworthy before use. Failing to do so can result in fixed penalties or court summons, with fines up to £2,500 and potential points on the driver’s licence.

Reporting Defects
Any defects found must be reported immediately using the company's defect reporting process. No vehicle should be operated if it is unsafe or if a defect poses a safety risk.
Legal Insight:
Regulation 100 of the Road Vehicles (Construction and Use) Regulations 1986 requires that vehicles be in a roadworthy condition. Failure to report defects can lead to prosecution.

Drivers are expected to be familiar with and adhere to the Highway Code. It provides essential guidance on safe and legal driving practices.

While not all parts of the Highway Code are legally binding, many are backed by law and breaching them can be used as evidence in court proceedings.

Speeding
Speed limits must be obeyed at all times. Excessive speed increases the risk of accidents and affects fuel efficiency and maintenance costs.
Legal Insight:
Exceeding the speed limit can result in 3-6 penalty points and fines of up to £1,000 (£2,500 on motorways). Speed awareness courses or prosecution may follow repeated offences.

Seatbelts
Seatbelts must be worn at all times where fitted. It is the driver's responsibility to ensure passengers are also complying.
Legal Insight:
It is a legal requirement under the Road Traffic Act 1988 to wear seatbelts. Fines can be issued up to £500 for non-compliance.

Parking and Parking Away from Depot
Vehicles must be parked safely and legally when unattended, especially if parked away from the depot. This includes securing the vehicle and avoiding obstructive or unsafe locations.

Illegal parking can result in penalty charge notices, clamping, or towing. It may also invalidate insurance if the vehicle is not secured.

Smoking is not permitted in any company vehicle. This includes the use of e-cigarettes.

It is illegal to smoke in work vehicles under the Health Act 2006. Offenders can be fined up to £200.

Mobile Phone Use
Drivers must not use handheld mobile phones while driving. Hands-free devices must not cause distraction, and calls should be kept to a minimum.

Using a handheld phone while driving can result in a £200 fine and 6 points on your licence. If a case goes to court, a driving ban and £1,000 fine is possible.

Drug and Alcohol
Zero tolerance is maintained for drug and alcohol use. Any use that impairs driving is prohibited and may lead to dismissal.
Legal Insight:
Driving under the influence is a criminal offence. Penalties include driving bans, unlimited fines, and up to 6 months in prison.

Prescription Drugs
Drivers must inform the company if taking prescription medication that may impair driving ability. Advice from a GP should be followed.
Legal Insight:
The Drug Driving (Specified Limits) Regulations 2014 also include some prescription drugs. Driving while impaired is illegal.

Drivers must follow all health and safety procedures, including correct lifting techniques, using PPE, and maintaining awareness of surroundings.

Employers and employees have duties under the Health and Safety at Work Act 1974. Breaches may result in enforcement or prosecution.

Manual Handling
Safe manual handling procedures must be followed. Drivers must not attempt to lift or carry heavy loads without training or assistance.

Under the Manual Handling Operations Regulations 1992, employers must reduce the risk of injury from manual handling. Drivers have a duty to comply.

Driver Fatigue
Drivers must ensure they are well rested before beginning duty and must take legally required breaks. Fatigue impairs judgement and reaction times.
Legal Insight:
Both GB and EU driver hours legislation mandate rest periods. Breaches may result in fines, O-licence action, or criminal prosecution.
